Rowdy Meeks Legal Group LLC filed a lawsuit on January 25, 2011 against Health Systems, Inc. (“HSI”) and its approximately sixty (60) nursing home facilities in Missouri for automatically deducting lunch time from employees’ paychecks, not paying employees for all work time, incorrectly rounding of employees’ work time, and failing to include certain bonuses in employees’ overtime pay rates. The lawsuit is Jade M. McClean et al v. Health Services, Inc. et al, Case No. 6:11-cv-03037-DGK, filed in Missouri Federal Western District Court in Springfield, Missouri.
The lawsuit alleges that EMS’ failure to pay hourly employees for all time worked including overtime violated the Fair Labor Standards Act (FLSA) and Missouri law. The lawsuit is a collective class action which means that other hourly employees at HSI’s 60 Missouri facilities may be eligible to join the lawsuit to recover their unpaid wages. The lawsuit alleges the HSI automatically deducted 30 minutes from hourly employees’ paychecks for lunch time whether or not the employees received a lunch break. The lawsuit further alleges that HSI forced employees to work off the clock without payment, rounded work time away to the employees’ detriment, and failed to include bonus paid to employees in their overtime rate of pay.
HSI may have impacted more than 10,000 hourly Missouri employees by its allegedly illegal wage policies and practices.
