Mortgage Loan Officers recently sued Primary Capital Advisors LC (“PCA”) on behalf of all Commissioned Loan Officers and other like jobs for unpaid overtime.  The lawsuit is Michael Pond v. Primary Capital Advisors LC, Case No. 11-cv-156-RJC-DSC and is pending in the Western District of North Carolina Federal District Court in Charlotte, North Carolina. The lawsuit is a collective class action which means that other current and former PCA Senior Loan Officers, Loan Officers, and Junior Loan Officers may join the case to seek their unpaid wages.

According to the lawsuit, PCA Loan Officers commonly work more than forty hours per week, but PCA fails to pay them overtime. The FLSA may permit these Loan Officers to recover their wages due including earned overtime.  They may also recover an equal amount for liquidated damages, interest, attorney’s fees, and litigation costs.
