Rowdy Meeks Legal Group LLC filed a lawsuit on April 20, 2012 against GGNSC Holdings, LLC d/b/a Golden LivingCenters (“Golden Living”) and its approximately three hundred (300) nursing home facilities in 21 states including Missouri for automatically deducting lunch time from employees’ paychecks, not paying employees for all work time, and unlawfully rounding away employees’ work time. The lawsuit is Bobbie J. Jarrett et al v. GGNSC Holdings, LLC et al, Case No. 2:12-cv-04105-FJG, filed in Federal Court, Western District of Missouri, in Jefferson City, Missouri.
The lawsuit alleges that Golden Living’s failure to pay hourly employees for all time worked including overtime violates the Fair Labor Standards Act (FLSA) and state wage and common laws. The lawsuit is pursued as a collective class action which means that other hourly employees at Golden Living’s 300 facilities nationwide may be eligible to join the lawsuit to recover their unpaid wages.
The lawsuit alleges the Golden Living automatically deducts 30 minutes from hourly employees’ paychecks for lunch time whether or not the employees received a lunch break. The lawsuit further alleges that Golden Living forced employees to work off the clock without payment and rounds work time away to the employees’ detriment.
Golden Living may have impacted more than 30,000 hourly employees by its allegedly illegal wage policies and practices.
