USA Mortgage Loan Processor Employees Lawsuit

DAS ACQUISITION COMPANY, LLC d/b/a USA MORTGAGE LOAN PROCESSOR EMPLOYEES SUE FOR LOST WAGES

Rowdy Meeks Legal Group LLC filed a lawsuit on January 10, 2013, on behalf of all current and former loan processors who worked during the last three years for DAS Acquisition Company, LLC d/b/a USA Mortgage (“DAS”), including all of its Branch and Corporate locations nationwide. This lawsuit alleges DAS unlawfully required its mortgage loan processors to report only 8 hours of work each day (or no more than 40 hours per week) regardless of the number of hours actually worked, and as a result, DAS unlawfully failed to accurately record and pay for all overtime hours worked. The lawsuit is Heather Pick v. DAS Acquisition Company, LLC, Case No. 4:13-cv-00051-JAR, filed in Federal Court, Eastern District of Missouri, in St. Louis, Missouri.

The lawsuit alleges that DAS’s failure to pay its hourly loan processor employees for all time worked including overtime violated the Fair Labor Standards Act (FLSA).  The lawsuit is pursued as a collective class action, conditionally certified by the Court, which means that all current and former hourly loan processor employees who were employed by DAS at any of their facilities during the last three years may be eligible to join the lawsuit to recover their unpaid wages.

In order to participate in this collective action to recover unpaid wages, employees must return a signed Consent Form no later than August 19, 2013.
