Federal Court Conditionally Certifies MLO and Processor OT Case Against DAS USA Mortgage

Case Description

Three former DAS employees filed a lawsuit seeking to recover overtime pay for working in excess of 40 hours in a workweek. The lawsuit claims that Mortgage Loan Originators (“MLOs”) and loan processor employees (“Processors”) worked for DAS, which allegedly failed to accurately record and pay for all time worked, including overtime premiums.

MLOs and Processors are eligible to join the lawsuit if they worked more than 40 hours in any week without receiving overtime premiums for all overtime hours worked. MLOs and Processors can join if they worked at DAS USA Mortgage at any time since June 25, 2021 including current and former MLOs and Processors.

On August 27, 2024, the three former DAS employees and DAS USA Mortgage filed a stipulated agreement with the court that agreed to conditionally certify the MLOs and Processors groups so that they would receive notice of the case and an opportunity to join. On September 9, 2024, the Court entered and adopted the agreement.

Notice

On November 6th, a third party administrator, Analytics LLC, issued notice of the case and an opportunity to join to MLOs and Processors via text, email, and U.S. mail. MLOs and Processors may join the case and become eligible to recover unpaid overtime by returning a signed consent form via online submission or U.S. mail. The deadline to join is January 6, 2025.
